Resilience Mental Health & Men's Wellness LLC may offer telehealth services via HIPAA-compliant video and messaging platforms. Sessions are conducted only through encrypted, HIPAA-compliant technology. We do not record sessions without your explicit written consent. Clinical notes from telehealth encounters are maintained in your medical record under the same confidentiality standards as in-person visits.
7. Data Security
We implement administrative, physical, and technical safeguards to protect your information against unauthorized access, use, alteration, or destruction. These measures include encrypted storage and transmission of electronic PHI, access controls, regular staff training, and secure disposal of records. In the event of a breach of unsecured PHI, we will notify affected individuals, the U.S. Department of Health and Human Services, and, if required, the media, in accordance with the HIPAA Breach Notification Rule.
8. Minor Patients
If you are the parent or legal guardian of a minor receiving services from our practice, your rights with respect to that minor's health information are governed by applicable state law. In Delaware and Texas, specific provisions govern when a minor may consent to their own treatment and when parental access to records may be restricted. 9. State-Specific Privacy Provisions
Delaware: Residents of Delaware are afforded privacy protections under the Delaware Code and the Delaware Health Care Claims Database Act. Mental health records may be subject to additional confidentiality protections under Delaware law. We comply fully with all applicable Delaware statutes governing the privacy and release of behavioral health information.
Texas: Texas residents are protected under the Texas Medical Records Privacy Act (TMRPA) and the Texas Health & Safety Code. These statutes may impose additional requirements beyond HIPAA. We fully comply with Texas law regarding the confidentiality of mental health and substance use records, and the rights of Texas patients to access and amend their health information.
