Non‑Discrimination Policy
1. Policy Statement
Resilience Mental Health & Men's Wellness LLC ("the Practice") does not discriminate in the provision of health care services, program participation, employment, or any aspect of practice operations on the basis of:
- Race, color, or ethnicity
- National origin, ancestry, or immigration status
- Religion or creed
- Sex, gender identity, or gender expression
- Sexual orientation
- Age
- Disability (physical, mental, or cognitive)
- Pregnancy, childbirth, or related medical conditions
- Veteran or military status
- Marital or family status
- Socioeconomic status or source of payment
- Genetic information
- Any other characteristic protected by applicable federal, state, or local law
This policy applies to all patients, prospective patients, caregivers, visitors, staff, contractors, and students affiliated with the Practice.
2. Legal Basis and Applicable Law
This policy is established in compliance with, and is informed by, the following federal and state laws and regulations:
Federal Law
Section 1557 of the Affordable Care Act (ACA); Title VI of the Civil Rights Act of 1964; Title VII of the Civil Rights Act of 1964; Section 504 of the Rehabilitation Act of 1973; The Americans with Disabilities Act of 1990 (ADA) and ADA Amendments Act of 2008; The Age Discrimination Act of 1975; Title IX of the Education Amendments of 1972; The Genetic Information Nondiscrimination Act (GINA) of 2008; The Mental Health Parity and Addiction Equity Act (MHPAEA).
Delaware State Law
Delaware Discrimination in Employment Act (DDEA), 19 Del. C. § 710 et seq.; Delaware Equal Accommodations Law, 6 Del. C. § 4500 et seq.; Delaware Human Relations Act; Delaware Code Title 16 , Health and Safety provisions regarding patient rights.
Texas State Law
Texas Labor Code, Chapter 21 , Texas Commission on Human Rights Act; Texas Health & Safety Code, Chapter 161 , Patient Rights; Texas Government Code , prohibiting discrimination in state‑funded programs.
3. Scope of This Policy
This Non‑Discrimination Policy applies to all aspects of the Practice's operations, including but not limited to: patient intake, scheduling, and appointment processes; clinical assessment, diagnosis, and treatment planning; provision of telehealth and in-person mental health services; referral and care coordination; billing, insurance, and financial assistance; communications, marketing materials, and digital content; staff hiring, training, promotion, and retention; vendor selection and contractor engagement; physical accessibility of practice facilities; and language access and communication support.
4. Accessibility and Reasonable Accommodations
4.1 Individuals with Disabilities
The Practice is committed to full compliance with the Americans with Disabilities Act and applicable state law. We will provide reasonable accommodations to individuals with physical, cognitive, sensory, or psychiatric disabilities to ensure equal access to our services. Reasonable accommodations may include accessible scheduling, modified intake forms, assistive technology during telehealth, flexible appointment structures, and referral coordination where specialized accessibility needs exceed our current capacity.
4.2 Language Access
Individuals with limited English proficiency (LEP) have the right to meaningful access to our services. The Practice will make reasonable efforts to provide qualified interpreter services (in-person or telephonic), translated written materials for essential documents where practicable, and culturally responsive communication strategies. We do not require patients to use family members, friends, or minor children as interpreters for clinical communications unless explicitly requested by the patient and clinically appropriate.
5. Affirming and Culturally Responsive Care
Resilience Mental Health & Men's Wellness LLC is dedicated to providing care that is affirming, culturally humble, and responsive to the diverse lived experiences of our patients. We recognize that mental health and wellness exist within broader social, cultural, and historical contexts. Accordingly, we commit to treating all patients with dignity, respect, and cultural sensitivity; providing LGBTQ+-affirming clinical care; recognizing and addressing the impact of structural racism, historical trauma, and systemic inequity on mental health; delivering men's wellness care that acknowledges the full spectrum of masculinity, identity, and emotional experience without stereotype or judgment; and engaging in ongoing cultural humility training for all clinical and administrative staff.
6. Prohibited Conduct
The following conduct is strictly prohibited within the Practice and will not be tolerated from any staff member, contractor, or affiliate:
- Refusing to provide services to any individual based on a protected characteristic
- Using derogatory, demeaning, or discriminatory language toward any patient, caregiver, or colleague
- Applying different standards of care or clinical judgment based on a patient's identity or background
- Discouraging an individual from seeking care based on a protected characteristic
- Retaliating against any person who reports discrimination or files a complaint
- Creating a hostile, intimidating, or unwelcoming environment for any patient or staff member
Violations of this policy by staff or contractors may result in disciplinary action up to and including termination of employment or contract, and may be reported to applicable licensing boards.
7. How to File a Non‑Discrimination Complaint
7.1 Internal Complaint Process
If you believe you have been subjected to discrimination or have witnessed discriminatory conduct in connection with our Practice, you are encouraged to report your concern promptly. Complaints may be submitted in writing to the Non‑Discrimination Coordinator, by telephone during business hours, by email to our designated compliance address, or anonymously (where possible). All complaints will be acknowledged within five (5) business days and investigated promptly, fairly, and confidentially.
7.2 External Complaint Process
You also have the right to file a complaint with the following external agencies at any time, regardless of whether you have first filed an internal complaint:

Filing a complaint with the Practice does not waive your right to file with any external agency, and filing externally does not preclude an internal review.

9. Staff Training and Accountability
All staff members, clinical providers, and contractors are required to: review and acknowledge this Non‑Discrimination Policy upon hire or engagement; complete annual training on non‑discrimination, cultural humility, implicit bias, and equitable care; complete training on ADA accommodations and language access obligations; and report witnessed discrimination or policy violations to the Non‑Discrimination Coordinator. The Practice will conduct periodic reviews of this policy and update training curricula to reflect changes in law, clinical best practices, and the needs of our patient population.
10. Policy Review and Amendments
This Non‑Discrimination Policy will be reviewed at least annually and updated as necessary to reflect changes in applicable law, regulatory guidance, or practice operations. Material revisions will be communicated to all staff and made available to patients upon request and on the Practice's website.
